Some thoughts from lawyers would be welcome!
Here’s what I’m thinking: bbc.co.uk/news/amp/uk-47…
- Revoke citizenship but only if she has alternative citizenship as otherwise stateless
- temporary exclusion order
- let her return and prosecute/not prosecute
- once child born it will presumably be a British citizen therefore welfare and best interests have to be considered which may mitigate against excluding
- threat of US sending to Guantanamo may create real risk of art3/6 breach if prevent return
- plus child vulnerability
- but prob no positive duty to go out and find her and bring home
Anything wrong/missing?
