Just discovering that in the event of no-deal, there is a loophole allowing for tariff-free imports into the UK. S 10(2)(b) of the EU (Withdrawal) Act 2018 prohibits any checks at the NI-Ireland border. UK cannot impose any checks or controls.
This means that all EU goods can cross this border freely. And it extends to third-country goods, destined for the UK market: they can enter Ireland, in transit to the UK. Of course the UK may provide for tariffs, but I can’t see how they will enforce them in Ireland.
The Act would need to be changed to plug this hole. Or am I missing something?
