Hello from #SCOTUS where we’ll get opinions at 10 followed by arguments in two criminal cases.

And now for some (correct) #SCOTUS stats! We’ve had 10 opinions in argued cases so far this #SCOTUS term. The court has reversed/vacated 6, affirmed 4. (Deleted earlier, out-of-date tweet.)
The longest outstanding cases were both argued Oct 2, the second day of the 2018 term. They are Gundy v United States (non-delegation) & Madison v. Alabama (capital case)
Circuit Standings: CA1 = 1-0; CA5 = 0-2; CA6 = 0-1; CA9 = 1-0; CA11 = 1-1; Fed Cir = 1-0; state courts = 0-2.
All but 1 of the decisions so far have been unanimous. Stokeling v. United States, the only divided decision, was 5-4.
The average time from argument to decision is 70 days. The longest is 104 by Gorsuch. The shortest is 36 by Ginsburg.
Percentage in majority: Thomas, Breyer, Alito, Gorsuch, Kavanaugh all at 100%. Roberts, Ginsburg, Sotomayor, Kagan all at 90%.

Justice Sotomayor has the opinion for a unanimous #SCOTUS in No 17-1094 Nutraceutical Corp v Lambert. CA9 is reversed, remanded.
In Nutraceutical #SCOTUS says Rule 23(f) is not subject to equitable tolling.
