Before you get excited about Allen Weisselberg testifying before Congress, recall that the Iran Contra prosecution of Oliver North was dropped because the immunity he was given to testify in Congress tainted the evidence against him. What does this mean? nytimes.com/1991/09/17/us/…
Weisselberg would likely assert his 5th Amendment right against self-incrimination if called to testify before Congress & decline to answer questions. Congress could compel him to answer by giving him immunity from prosecution based on those answers.
That means neither his answers nor anything obtained as a result of them could be used as evidence against him. And there’s a high burden on the prosecution to show all of their evidence is independent. In the North case, this problem ended the prosecution.
Hopefully Congress will coordinate with prosecutors to insure no problems arise here that could interfere with prosecuting people who have violated the law.
