NEW: A federal judge in California just issued a preliminary injunction blocking the Trump administration from returning non-Mexican asylum seekers to Mexico while their immigration cases are pending — order takes effect April 12 at 5pm PST assets.documentcloud.org/documents/5798…
The judge makes clear that his ruling isn't about whether Congress or DHS *could* do this at some point, but rather it's about the way the Trump admin tried to do it here — that the law DHS is relying on doesn't apply, and regardless, the plan doesn't do enough to protect people

Hello on this gorgeous spring morning from SCOTUS, where the justices are hearing a big one: Whether the Trump administration can add a citizenship question to the 2020 Census. Lower courts repeatedly have ruled against the government, and now we're at the final stop. Stay tuned.
Here's @dominicholden on the ruling in January from Manhattan federal judge Jesse Furman blocking the administration from putting the citizenship Q on the 2020 Census: buzzfeednews.com/article/domini… Furman wrote the Q "was unlawful for a multitude of independent reasons"
The challengers argue adding a citizenship question would lead to a lower, less accurate count — the census determines everything from congressional districts to federal budgets — because it would scare off households that include noncitizens from filling out the questionnaire

Notably, unlike Judge Furman's ruling in New York, Judge Seeborg found the citizenship question unconstitutional in defiance of the Enumeration Clause.

It's a far more sweeping victory for the challengers.

On May 31st, the Trump administration transferred 124 asylum seekers to a federal prison in rural Sheridan, Oregon. The results were horrifying. A lot has happened since. Thread. /1
We know now that both prison officials and local ICE had less than 24 hours notice and were wholly unprepared to receive 120+ immigrant detainees. As a result, the asylum seekers were locked in cells for 23 hours a day, three to a cell. /2
More than 50 of the asylum seekers were Sikh men from India. They were denied the right to wear their turbans and for a month were denied vegetarian meals and instead given religiously inappropriate meat meals. So they went hungry. /3

Last week, ICE put our clients — an asylum-seeking mother and child — on a deportation plane, violating the government’s promise to the court.

The judge ordered them to “turn that plane around.”
Today, the government explained that it had never entered its non-deport promise into its database.

So ICE agents took Carmen and her daughter from their room in the middle of the night and, ignoring her protests, loaded them on the plane.

It was terrifying for them.
What the government did to Carmen and her daughter reflects the Trump administration’s broader stance on asylum seekers. In a rush to deport as many immigrants as possible, more lives will be put at risk.

We will continue to fight for Carmen and all of our clients in court.
