NEW: Julian Assange charged with a computer hacking conspiracy, not with Espionage Act violations.

This is the crux of the charges, dated March 2018.
Observation: The chat logs supporting Assange’s indictment have been publicly known (at least in part) far back as late 2011, when they were first introduced as evidence in Manning’s pre-trial proceedings.

Assange’s indictment quoting from them was signed last year.

In a decade of covering the courts, I can’t remember:

* ever attending a DOJ press conference about an indictment or report where the documents at issue were not immediately available.

* being told documents were only available in hard copy.

Most are electronically searchable.
It’s mildly aggravating when I am forced to use my OCR software. Anything beyond than that feels like a provocation in the 21st century media ecosystem.
Don’t get me wrong:

There have been times when I’ve obtained files that were only available in hard copy form. Sometimes in state courts.

Sometimes the kind of federal court documents that you have to dig for, not the major ones the DOJ distributes.

As we await the [REDACTED] Mueller report, let's evaluate the circumstantial evidence of what it suggests that federal prosecutors—in a newly unsealed document—decided what to shield a paragraph on their probe into Julian Assange.

Remember: The indictment is now public.
Why also is the "Filed" field of the Criminal Case Cover Sheet "REDACTED"?

The magistrate docket, pre-indictment, remains "SEALED," though it's marked sometime in 2017.

When that year is anybody's guess.
"The government requests that the Motion to Seal filed on December 21, 2017 ... remain under seal because it contains nonpublic information about an ongoing criminal investigation."

The redacted paragraph at the top of this thread is that motion.

"While it remains unknown whether Manning and Assange were successful in cracking the password, a follow-up message from Assange to Manning on March 10, 2010, reflects that Assange was actively trying to crack the password pursuant to their agreement."

A few observations about the affidavit:

* It's dated December 2017, pre-indictment, seeking arrest warrant and criminal complaint.
* Appears to be based mostly (if not wholly) on Manning-"NF" chat logs that have been publicly known since 2011
* FBI: "NF"=Assange
Prosecutors have long believed "NF" to be an Assange pseudonym in these chats, short for "Nathaniel Frank."

The Assange indictment seeks to allay press freedom concerns by focusing on an allegation that he tried to help Manning “crack” a DOD password—i.e. entering into a conspiracy to steal rather than simply receiving info. justice.gov/usao-edva/pres…
There’s no allegation that they successfully broke into SIPRnet, and the seriousness of Assange’s effort is unclear, so I think people can reasonably argue the charges are pretextual and chilling. It’s an argument that will have to look past the face of the indictment tho.
The evidence Assange tried to “crack” the password? He said he failed, at least initially.

Some journalists keenly cite FBI informer Marcy Wheeler's wild & eager speculations on EDVA's #Assange indictment. But indications so far in fact point to the indictment relating to @xychelsea's case & @WikiLeaks revelations of US wars in Iraq, Afghanistan, Cablegate, GITMO.
First of all, the document indicates that the indictment is in the Eastern District of Virginia (EDVA). This is where the WikiLeaks Grand Jury (Ref:10GJ3793) has been empanelled since 2010 in order to indict Assange over the publications that Chelsea Manning was convicted over.
The @WikiLeaks Grand Jury was headed at the time by Neil MacBride (who was also responsible for the prosecution of CIA whistleblower @JohnKiriakou). MacBride is an aggressive proponent of the extraterritorial application of US criminal jurisdiction. washingtonpost.com/world/national…
