NEW: A federal judge in DC has rejected Trump's latest effort to get claims dismissed (in this case filed by congressional Dems) accusing him of violating the emoluments clauses re: his business interests assets.documentcloud.org/documents/5983…
Judge Emmet Sullivan in DC rejected Trump's effort to narrowly define "emolument" — Sullivan is now the second judge to rule this way, a judge in Maryland was the first. The Maryland case is pending before the 4th Circuit right now
The DC and MD cases are both broadly about the emoluments issue, but the details differ. The DC case is just about the Foreign Emoluments Clause, and covers a range of Trump co. business. The MD case is about the Foreign and Domestic clauses, and is limited to Trump's DC hotel
Trump has argued for a narrow definition of "emolument" — if he gets $/something of value for doing something in his official capacity. Congressional Dems (and DC and MD, in the MD case), argued for a definition broadly covering profits/gains. Two judges have agreed w/ the latter
Sullivan also rejected Trump's args that individual members of Congress, as opposed to Congress as a whole, couldn't sue to enforce their authority (the Foreign Emols Clause says the pres can't accept emols w/out Congress' approval), and that the court shouldn't get involved
