.@jacklgoldsmith made a similar point on @lawfareblog - Mueller's decision not to make a recommendation allowed him to avoid having the AG review his decision.
This choice does not reflect well on Mueller. All along, the special counsel was drafting an impeachment referral for Congress. That was not his job.
I agree with @DavidRivkin and Liz Foley "The only way to restore the separation of powers and prevent further damage is to ensure that Congress cannot outsource any aspect of its impeachment powers." wsj.com/articles/congr…
