1. Why is Barr trying to avoid being found in contempt of Congress? I've seen no authority that addresses the bar discipline impact of a finding of contempt of Congress. But finding of contempt of court can cost you your license. The Journal of the Legal Profession Vol. 13:271 (1988)
2. I concede Barr is facing contempt of Congress, not contempt of court. But from a functional perspective both findings carry potential criminal sanctions. Plus I can't see how contempt of court could rise to a charge of obstruction but can't say the same for Barr's conduct
3. that IMO could rise to a charge of obstruction under 18 USC 1505. If you add to this that Mueller found a dozen or so RICO predicates, obstruction resulting in a contempt finding may result in Barr becoming embroiled in a fight to save his license.
4. I recognize Eric Holder was held in contempt. First no prosecutor would take up the case. But more importantly Holder was never considered to be engaged in helping Russian intel asset obstruct justice and hide secret deals with the Kremlin. Facts matter
5. in attorney discipline and Barr is way out on an ethical limb. He's arguably committed an 18 USC 1001 violation lying to Congress and is now obstructing the @HouseJudiciary. His little retired CIA agent dangle op to get Trump to make him AG may turn around and bite him.
6. We'll see if he thinks his future is worth more than Trump's.
