This is such an incredible abuse of the Federal Vacancies Reform Act process, I wonder if any congressional Republican (besides maybe Rep. @justinamash) will call out the administration for doing so.

I'd add that this is even more problematic than it at first appears because the creation of this new position is being done by an acting secretary who himself is only in his position because the Trump administration pushed out people ahead of him in the DHS line of succession.

Maryland initiated a legal challenge when it asked a court to find that Whitaker’s appointment is illegal.

It’s not clear that Trump could legally fire Sessions and replace him with Pruitt — it’s disputed whether the Federal Vacancies Reform Act applies to firings as opposed to resignations/death. 1/
That’s why WH claimed (laughably) that VA Secretary Shulkin resigned when it was obvious he had been fired. 2/ politico.com/story/2018/03/…

Even if Trump can fire Mueller directly – I doubt he can legally, but he might try – there’s no value in firing *only* Mueller. Rosenstein could just appoint a replacement, and the investigation would continue. Let's examine what Trump might do instead. 1/
He could fire Mueller and, simultaneously, fire Sessions and/or Rosenstein, to prevent the naming of a replacement. But Mueller could challenge his firing and might well win. 2/
Alternatively, he could fire Sessions or Rosenstein and install someone who might go after Mueller. Let’s analyze the mechanics of that, which are tricky. 3/
