If you are concerned by the decision it means that you are aware of the damage done by the High Court to our freedom to live in democracy.

I have read the comments that the matter could have been presented differently to the court and to some extent I agree. #auspol #auslaw

The submissions to the court were somewhat restrained by the case as presented to the AAT in the first instance.

But the HCA is a court of equity as well as a court of law, and therefore its black letter decision represents a failure of justice.

I've made submissions to various courts I'm aware that arguments may be presented in a variety of ways, it being a real dilemma to choose.

The case presented to the HCA by Merkel was very different to the case I presented in the Federal Circuit Court in 2013.

At this early stage I am writing a considered reply to the HCA judgment but it is not ready to post yet. I will as soon as I can.
