#breaking Michaela Banerji has unanimously lost the High Court case against Comcare on freedom of political communication. Decision upholds decision to sack her and APS code of conduct restricting even private anonymous social media posts. #auspol #auslaw
The majority judgment of Kiefel, Bell Keane and Nettle is based on fact implied freedom doesn't give personal rights, and notes that code of conduct applies to ALL social media posts due to risk of de-anonymisation.
Although majority leaves door ajar for implied freedom to restrict some executive decisions/discretions
In separate judgments Edelman and Gageler have some sympathy with how deep an imposition on free speech this, but find the public service gag laws are "reasonably necessary and adequately balanced".
For people asking the "what about Folau/private employment contracts" question - this case has no bearing on that. Implied freedom of political communication will never save you from overzealous social media policies where your employer is not the govt.

Whistleblower PID disclosures don't cover info about politicians, law enforcement mostly refers to another agency, privileges committee is set up to protect politicians. How can ordinary people counteract these failures in governance and accountability without breaking a law?
What about reports of political interference eg. #Helloworld contract incl input by a former polllie who is a large shareholder. Is there an ongoing investigation? It's up to agencies to refer to law enforcement ie. @AusFedPolice who should be able to investigate unhindered.

Thread: On Wednesday, the @HighCourtofAus hears @comcare_gov_au v Banerji (@LaLegale), one of the most important free speech/freedom of political communication cases in years. At issue is whether the govt can legally terminate an APS employee for their political communication.
The respondent was a Department of Immigration employee in the early 2010s, tweeting criticism of government border protection policy via a pseudonym. One of her colleagues suspected the tweets came from her; the Dept investigated and proposed to terminate Banerji's employment.
Banerji sought an injunction in the Federal Circuit Court, contending the proposed termination was unconstitutional by reference to a broad free speech right. In August 2013 Judge Neville rejected the application: 'The unbridled right championed by Ms Banerji ... does not exist'

A reminder: the Court of Appeal hearing against the Department is due to start next month with regard to access to the concession agreement under FOI - the Department lost the High Court case.
Anyways! What are these "cost savings" of €22 million? Let's dig for a second.
