Remember how the ACLU accused the Trump admin on wrongfully separating families at the border *after* a judge entered an injunction? (see: buzzfeednews.com/article/zoetil…) The govt filed its response last night, arguing they're reasonably exercising discretion

The judge carved out an exception for parents with criminal history or who were otherwise deemed unfit, but the ACLU argued the govt was interpreting and applying that too broadly. Nearly 1,000 immigrant children have been separated from parents since the June 2018 injunction

DOJ argues the govt considers parents' criminal history in the context of who can be held in a family residential center, who can be released, and severity of the crim history. They also say some of those families are being reunified.

The judge will hear arguments on Sept. 20.
