Yesterday, the California legislature passed #AB32, banning (in the near future) the operation of for-profit prisons, jails, & detention centers in the state and of sending state prisoners out of state to for-profit prisons. 1/

There's a not too modest loophole that allows the state to "renew or extend a contract with a private, for-profit prison facility" ... "in order to comply with the requirements of any court-ordered population cap." 3/
How many people locked in California might this law impact? And how? There are about 4,500 people locked in private detention centers as ICE detainees and a bit under 2,000 under CDCR custody in private prisons. Here's the CDCR Sept 11 population count for contracted 'beds.': 4/
Some or all of the ICE detainees might end up in public prisons or jails contracting with ICE or to other prisons run by GEO. 5/
But because #AB32 does not ban ICE, CDCR or the Federal Marshalls from contracting with public agencies, there's a good chance that all the 2,000 CDCR prisoners will end up in California jails, and a fair number of the ICE detainees might as well. 6/
California counties are building or planning thousands of new jail cells, despite the state's jail population being flat for years and about 6,000 below "rated capacity." (79,210 capacity / 73,497 average daily population) 7/
