On a call with reporters this morning, DOJ and DHS officials did not clarify whether individuals who entered/attempted to enter before 7/16 (the date of the asylum ban) & were placed into Remain in Mexico will have the ban applied to them in court.
This is a big question.

These individuals "enter" each time they appear for their immigration court proceedings in the U.S. Will the bar apply to them even if they had initially come to the border pre 7/16? The answers we got today were less than clear.
This could end up placing immigration judges in a tough position.

The guidance sent to judges on Thursday does not specifically discuss this question -- it's very vague.
DHS official clarifies that the asylum ban WILL NOT be applied to those who were placed into MPP/Remain In Mexico before 7/16.

Immigration court official to me:

"With MPP in general, immigration judges are treading in new legal territory, interpreting the law to the best of their abilities. They have not received guidance from the Board of Immigration Appeals or any other entity...."
"It is likely that this trend will continue with this new rule..."
