NEW: Immigration judges received guidance Thursday on the SCOTUS ruling allowing the Trump administration's asylum ban to be enforced across the southern border.

The guidance, in a thread:

Applications filed by "aliens who entered attempted to enter or arrive in the US on or after 7/16/19-whether filed affirmatively w/ USCIS or defensively in removal proceedings-that remain pending (whether before USCIS, before an immigration judge or before the BIA) after 9/11/19"

In other words, the asylum bar will apply to those who crossed after 7/16/19 & have their deportation court proceedings post 9/11 (the date of the SCOTUS ruling).

The guidance also lays out how the asylum ban will apply to those who have a case pending appeal before the Board of Immigration Appeals (BIA) after 9/11/19 & who fit the parameters of the ban (crossed through Mexico on the way to US border, got to US on 7/16/19).

This policy will essentially bar from asylum anyone who crossed through Mexico and made it to the southern border EVEN if they were able to pass the first asylum screening bc a federal judge blocked the policy.

Major implications. Now, judges must enforce it.

It’s unclear at this point whether those who crossed before 7/16 and are in MPP proceedings will have the asylum ban applied to them. These individuals re-enter for each hearing.

Guidance doesn’t make clear what to do for these people.
