Today is Constitution Day & many of my peers have chosen to focus on celebrating the document's many strengths. However, I'm going to focus on two glaring weaknesses. 1. the document provides no direction on what to do when a newly elected POTUS has been compromised by a hostile
foreign power. As such, when confronted w this scenario, we had no choice not only to read this individual into all of our nation's most closely held state secrets, but also to allow the individual to assume the presidency, and, according to legal analysis anyway, legal immunity.
2nd: the impeachment powers written into the Constitution, ostensibly to offset the POTUS legal immunity issue, were designed based on what apparently was a flawed assumption. That assumption was that in the face of clear illegal behavior, Congress would be compelled to act.
Clearly, the Constitution is inadequate to guarantee action and fails due to its inability to anticipate the power of partisan calculation. In the case of both Senate Rs and House Ds, both party's are content to betray the the Rule of Law for political expediency. There are other
weaknesses that have been exposed in the past few decades; language within the 1st Amendment that allows for too much $ in politics, ambiguous wording in the 2nd Amendment which serves as a shield for inaction on the country's mass murder issue. And the separation of powers
model, so beautifully articulated by Madison, which until the parties (but particularly the Republican Party) divorced itself from shame functioned to both moderate and facilitate change for two centuries reasonably well. But it has become increasingly clear our Constitution
a major upgrading. And that's a problem because the only system we can avail ourselves to fixing it is the same system that is horrendously broken right now.
Adding to this tweet thread bc I just heard a segment from @JoeBiden arguing that our system is fine, its our politics that's broken.

He could not be more wrong.
