To avoid the Benn Act obligation to send an application for an extension MPs would have to approve the specific motion in section 1(2)(a) of that Act. 1/2
The motion is “That this House approves the withdrawal of the United Kingdom from the European Union under Article 50 of the Treaty on European Union on exit day, without a withdrawal agreement...” A single motion obliging MPs to choose won't vitiate the Benn Act obligation. 2/2
Again, this does not work.

The Benn Act is prescriptive as to the motions. If the PM puts this motion and then fails to send the Benn Act letter we *will* pursue contempt proceedings against him and the Advocate General for Scotland.
This also doesn't work. Until "political agreement" (see s.13(1)(a)(i) of the 2018 Act) has been reached there can be no WA vote under the 2018 Act or WAB or (imo) Benn Act vote under s.1(1) thereof. But atm, the WA is only agreed at "negotiators" level.
