BREAKING: Jury finds in favor of Planned Parenthood all civil claims, awards $870k in punitive damages @CourthouseNews
@CourthouseNews The jury found David Daleiden and all of his Center for Medical Progress colleagues liable for trespass, fraud, breach of contract, civil racketeering, and violation of federal and state (California, Florida & Maryland) recording laws. Compensatory damages well over $400K.
@CourthouseNews Daleiden and co-defendant Sandra Merritt are still facing criminal changes for invasion of privacy and eavesdropping for recording abortion providers. They will be back in criminal court on Dec. 6.
@CourthouseNews The jury found Daleiden personally liable for $125K of the $870K in punitive damages. Here's the breakdown of the rest:
The Center for Medical Progress: $400K
Sandra Merritt: $25K
BioMax, Daleiden's fake company: $200K
Albin Rhomberg: $70K
Troy Newman: $50K
@CourthouseNews Defense attorneys said the jury was "straight-jacketed" by Judge Orrick's myriad "unfair rulings," both during the trial and before. Orrick didn't allow certain witnesses to testify, and didn't allow certain evidence in.
@CourthouseNews The defense also took issue with the jury instructions and verdict form, calling them "slanted." From Peter Breen outside the courtroom: "Our expectations from this jury were not high."
@CourthouseNews While Planned Parenthood's lawyers declined to speak with the press, I did get a statement from lead counsel Rhonda Trotter, which will be included with the updated story @CourthouseNews. She noted that total damages (punitive + compensatory) is $2.275 million
