Indeed, as a check of the relevant government website 30 seconds ago confirms, it appears that Ken Cuccinelli is both the Senior Official Performing the Duties of the Deputy Secretary AND still the Acting USCIS Director.
What does that mean on a practical level? God only knows.

As of 11:53 AM on Monday the 25th, eleven days after Ken Cuccinnelli supposedly became the SOPtDo the DHS Deputy Secretary, he remains listed as the Acting Secretary on USCIS's website, and is also listed on DHS's website as holding both positions. 
One upshot of the utter confusion about who is in charge at DHS is that every single plaintiff filing a lawsuit against a USCIS policy enacted since Cuccinelli was appointed, or enacted at DHS since Wolf took control, should include challenges to their appointment.
