2. I think these replies are too cynical.
I get the frustration w/ her, but this statement on Day 1 is significant, knowing it's big news, tends to box her in, and adds cover for/pressure on other GOP Senators.
The odds flipped.

The Letter letter to the DC Circuit asking to take judicial notice that Trump's lawyers contradicting their legal arguments.
You might call this a form of estoppel.
Or after so much bad faith flip-flopping, it's simply legal karma.
I think the same judicial notice/estoppel argument could be made against Team Trump's arguments in the tax return subpoena cases and against Judge Rao's dissent, that they concede federal jurisdiction to subpoena and investigate the president.
Judicial estoppel is an "equitable" doctrine applied flexibly to prevent a party from relying on one argument to prevail in one phase of a case, then relying on a contradictory argument to prevail in another phase...

The U.S. Senate is now voting to table the Schumer amendment to subpoena documents.
McConnell is seeking to "table" the amendment, which is the equivalent of killing it.
The U.S. Senate, 53-47, voted to table the first Schumer amendment to subpoena the White House for Ukraine related documents.
That amendment now dead.
Onto Schumer Amendment #2.
The U.S. Senate is now voting on whether to table the second amendment - to subpoena the State Department.

Good morning. We start President Donald Trump's impeachment trial in the Senate with debate and then a vote on the rules that will guide how the trial unfolds. I will frequently be reporting from inside the chamber and largely relegated to pen/pad until I can access electronics.
I hope you will continue to follow along here for updates and color as the trial progresses!

Debate in Senate starts at 1PM ET today, both sides get an hour. Then, expected around 3PM ET, Dems propose amendments to GOP resolution and eventually, some time tonight, they vote.

Trump is an unindicted co-conspirator in criminal case involving his hush payments to women he slept with right after his 3rd wife gave birth to his 5th child. He, Ivanka, Don Jr, and Eric are under investigation for fraud and tax evasion.
