The decision revives a 2017 lawsuit brought by several organizations and individuals who argue that FOSTA punishes certain types of speech - including advocacy for decriminalizing sex work - and contains vague terms that sweep up a host of online speech.
FOSTA's vague terms and massive liability have driven speakers offline and forced platforms to shut down or not host certain types of speech. A recent study confirmed FOSTA's harmful impact.
