1. I reviewed the DC Circuit opinion affirming Judge Jackson's summary judgment order in the @CREWcrew v DOJ case. When a DOJ changes command at the end of an administration, there are loose ends.
This case was originally filed May 29, 2019.
2. The summary judgment briefing was completed on October 21, 2020. Then it appears that judge Jackson requested the memo that was the basis for the #45 DOJ's claim of deliberative process FOIA exemption that was delivered for in camera inspection on March 8, 2021.
3. Merrick Garland assumed his position as AG on March 11, 2021. On May 3, 2021, judge Jackson issued her ruling on the cross-motions for summary judgment and on May 24, 2021 the DOJ filed its appeal to the DC Circuit.
