SCOTUS decisions in 45 minutes. I need a drink.
(We don't know which rulings are coming down today, just that there will be some. We're getting close to the end of term, which means probably at least one big one today.)
Nineteen cases left this term. Decisions are announced at 10 AM on pre-specified days. The term will almost certainly be over by the end of the month—twelve days from now.
Among the cases still outstanding are the travel ban, two on gerrymandering, a huge union rights case, and one on warrantless searches of cellphone location data.
Decisions drop on Mondays, and near the end of the term they add additional decision days. Probably 3–5 rulings today, maybe another batch this Thursday.
On decision days at the end of the term, I watch the @SCOTUSblog livefeed for info. They announce the rulings as they come, post links to full text quickly, and tend not to jump the gun on interpretation and analysis. live.scotusblog.com/Event/Live_blo…
First decision today is Sotomayor writing in Rosales-Mireles. It's a 7-2 ruling that (oversimplified) if a judge screws up in calculating your sentence, appeals courts can fix it. supremecourt.gov/opinions/17pdf…
Alito and Thomas dissent, telling convicts who were the victim of clear judicial error to go screw themselves.
Second decision is Breyer writing for a 5-3 majority in Chavez-Mesa, another sentencing case. Not going to try to summarize it, because it's technical and narrow and I'll screw it up. supremecourt.gov/opinions/17pdf…
Third decision: Kennedy writing for 8-1 majority in Lozman, in support of a guy who was arrested while speaking at a city council meeting. Another narrow ruling. supremecourt.gov/opinions/17pdf…
Sole dissent in Lozman is Justice Thomas, striking his favored "snarky weirdo" tone.
Next up is Gill v. Whitman, the Wisconsin districting case. Court bounces it back to the lower courts to address a "standing" issue—whether the people who brought the case have grounds to do so. supremecourt.gov/opinions/17pdf…
List of which justices signed on to which parts of the Gill decision. Fun!
TL;DR: The Wisconsin redistricting case is going to be back next term, but several of the justices are planting flags now.
Another gerrymander case, another punt—unsigned decision in Benisek backing up a judge's decision to slow-walk a challenge to Maryland's districting. supremecourt.gov/opinions/17pdf…
And that's it for today. With Gill getting bounced, Carpenter—the Fourth Amendment case on cellphone location records—is now the oldest outstanding case remaining.
Aside from Carpenter, still waiting on Janus (unions), Trump (travel ban), Abbott (Texas redistricting), and ten others, if I've counted right.
SCOTUS has announced that there will be more decisions on Thursday at 10. See you then. Off to read Kagan's concurrence in Gill.
So in Gill, Roberts says the plaintiffs haven't proved they have standing to bring their suit. Kagan, joined by the Court's other liberals, nudges them forward with advice on how to prove it.
Okay. Kagan's concurrence is bringing the heat. New thread.
