You may recall that, back in May of last year, one of our friends asked DExEU for a copy of the UK’s decision to leave the EU:

You may also recall that on 12 June, the Divisional Court found that the UK’s decision to leave the EU was taken by the PM herself when she signed the A50 notification letter on 29 March 2017

Which of course is NOT what DExEU told our friend back in May (two months after the decision)

So our friend asked whether DExEU had been aware at the time of their request that the decision had been taken by the PM and, if not, why not.

DExEU responded today that, since the court case had not happened when they responded, their response was factually correct at the time they made it.

Which brings us to some interesting questions:
a. As the department responsible for Brexit, how could they NOT know the decision to leave had been taken?

b. If in fact the decision had NOT been taken by May 2017 (“factually correct”), have they told the EU that the notification was in error?
