Drinking to excess is not synonymous with blacking out (having memory gaps). Kavanaugh implied the former by denying the latter.
Kavanaugh claimed it was “legal to drink” in his senior year. Not true. The legal drinking age in Maryland had been raised to 21 before he turned 18. And 1982, the summer in question, was the summer BEFORE his senior year. He turned 18 in 1983.
THIS from Sen. Richard Blumenthal (D-CT): juries are “instructed that they can ‘disbelieve a witness if they find them to be false in one thing’.”
That’s one flat out lie and two attempts to deflect - that he was a senior, that he didn’t drink to excess.
In response to questions, Kavanagh said he was “Captain of the varsity basketball team. Got in Yale College.”

The juxtaposition sounds like Kavanaugh was captain of the Yale varsity basketball team. He was NOT a member of the Yale varsity team. Junior varsity, yes.
That wasn’t his only sports reference. In referring to sports at least 50 times, Kavanaugh “belabor[ed] the idea that his fitness on the court had some obvious connection to his fitness for the Court.”

One more time: a deliberate implication that he was not an underage drinker (he was).

Why would Kavanaugh tell a tale so easily shown as false? Why focus on legality when that’s not the issue?

We expect judges to be precise. His behavior is its opposite.
As recently as 2016 Kavanaugh thought lie detectors were appropriate screening tools for law enforcement agencies to use in hiring decisions.

And he is in the midst of an extended job interview.
