Headed to Senate Commerce hearing on consumer data and privacy. Thoughtful written remarks from @lauramoy, particularly on the importance of context and consumer expectations. Much to discuss. Look forward to hearing more. commerce.senate.gov/public/_cache/…
Her point on context of data collection, limited choices certainly points back to the Google Data Collection research @DCNorg distributed which showed it’s near impossible to avoid Google collecting your data. This requires a higher bar.
Chair of EU Data Protection Board cites @BrendanEich letter to Senate Commerce stating the US needs GDPR-like protections. Ends with Brandeis, “right to be left alone [is] the most comprehensive of rights, and the right most valued by free people.” commerce.senate.gov/public/_cache/…
And MacTaggart. Summary and background on California and GDPR. Worth noting his concern around Google, Facebook taking advantage of opt-in consent. The answer to this, though, is purpose limitations out of context. Otherwise duopoly will always win. commerce.senate.gov/public/_cache/…
Chairman of Senate Commerce @SenJohnThune on testimony from Google, AT&T and other industry players two weeks ago: “while the experience of such companies is important to consider, I want to be clear that the next federal privacy law will not be written by industry.”
Senator @SenMarkey companies should only collect data required to carry out a requested service which is a key point to aligning with consumer expectations and context and richly executed would prevent the unbridled data collection by Google and Facebook across the web.
And @SenJohnThune starts off with a question on the first major GDPR investigation (Facebook, last week). Big tech lobbyists want public and lawmakers to believe strong data protection is bad because big companies will avoid enforcement so this answer matters. Clear proof point.
If the question is whether EU will actually enforce GDPR, Dr Jelinek’s answer makes it clear they’re moving toward it with several hundred cases assigned. She says valid consent is the most common issue.
Interesting. @SenBlumenthal states he’s going to ask FTC to investigate Google based on report this week. EU also investigating but apparently under pre-GDPR law despite Google knowing about it and not informing the public for months after GDPR was in place? Surprised by this.

Good caution reminder by @privacymama that Cambridge Analytica was a small company. Worth pointing out GSR (company that took the data and sold it to them) was 3 people. Also worth pointing out Facebook hired one of them while report was being investigated by @guardian.
I’ve already heard reference in hearing to reports from @WSJ, @nytimes, @AP, @ProPublica, @washingtonpost. We shouldn’t have to be dependent on our free press to keep Google and Facebook in line although I tip my hat to @JuliaAngwin, @carolecadwalla, @lizzadwoskin, many others.
Bumping this up for those with GDPR and US implications on their mind. It’s an important q&a with @Buttarelli_G and gets around the noise surrounding us from industry stakeholder op-eds. blogs.thomsonreuters.com/answerson/unde…
Zing. That’s the headline. @SenJohnThune asks about testimony two weeks ago from big tech on costs of GDPR implementation. Jelinek shoots down Google’s ridiculous math on it by reverse engineering against their earnings/headcount to point out it was a few hours of time. Love.
Dear Europe: Your Data Protection Board Chair flew to Washington to testify before our @SenateCommerce Committee regarding GDPR.
And she literally owned Google on their garbage talking points. Congrats and well done. c-span.org/video/?c475482…
