but one that no-one's noticed until now, which makes me wonder how valid it might be

I assume agt is like that for not having an unlimited transition period: infringement of 3rd-state relations provisions in EU treaties.

If backstop in place indefinitely, then becomes de facto 3rd-state relation, but on 'wrong' legal basis

counter-agt might be that it's contingent on failure to agree alternative arrangements, so axiomatically only in place when nothing else is
