A reminder that we could hear from #SCOTUS as early as today with respect to whether it will continue or vacate Chief Justice Roberts’s administrative stay of the contempt citation against the unnamed foreign company that apparently defying a Mueller-related grand jury subpoena.

How messed up are the #GTMO military commissions? Read the DC Cir. reply brief on how the judge in the capital trial of the alleged USS Cole mastermind willfully concealed an insurmountable ethical conflict that now requires vacatur of all of his rulings:

One of the many troubling takeaways from the brief is how complicit the government has been in trying to obfuscate / otherwise downplay the judge's flagrant violation of various ethical rules here—& how much it might have succeeded but for what @carolrosenberg uncovered via FOIA.
And the timeline that comes through from the FOIA disclosures with regard to how Judge Spath's potential (& pending) future employment as an immigration judge could reasonably be feared to have influenced his decisionmaking as the trial judge in Al-Nashiri is, in a word, damning:

In all of American history, there has _never_ been a federal judge whose final confirmation vote was determined by a vice-presidential tiebreaker...
(In 1986, then-Vice President George H.W. Bush unnecessarily broke a tie on a procedural motion with respect to the confirmation of Judge Daniel Manion, but the final vote to confirm him was 48-46.)

The filings at SCOTUS are under seal, so we can’t read them, as it was at the DC Circuit. All we know about the dispute came in the brief circuit order denying the company’s stay request. Chief Justice Roberts put the contempt order in hold while SCOTUS considers the matter.
The company challenging the contempt order in the mystery grand jury matter has filed a reply (under seal, as with the other filings, so we don’t know what it says) at #SCOTUS.

BREAKING: The company owned by a foreign country that is challenging a grand jury subpoena in federal court in DC, and lost its challenge at the DC Circuit, has asked the US Supreme Court to step in. The case is under seal, so we have no additional information at this time.
It is an application for a stay, so likely an effort to stay the lower courts’ refusal to quash the subpoena and halt the continuing fines on the company for not complying (similar to what was sought in the DC Circuit).
