#SCOTUS, Oct. 1, 2018. We’re back.
This morning, the big, 75-page orders list is out. It's mainly denials of cert requests that came in over the summer. No new cases are granted (we got those last Thursday). #SCOTUS
We did get several CVSG (calls for the view of the solicitor general) —>
- Poarch Band of Creek Indians v. Wilkes (17-1175)
- Atlantic Richfield Co. v. Christian (17-1498)
- Clearstream Banking v. Peterson and related cases (17-1529, 1530, 1534)
- Hernandez v. Mesa (17-1678)

On this First Monday, as I noted last night ...
Significant discussion of ... draining the swamp ... at this morning’s first argument of the term. #SCOTUS
Seriously, in a case over designation of “critical habitat,” Justice Breyer talked about a hypothetical scenario in which “draining the swamp” would be necessary to make the land habitable for the species in question. Chief Justice Roberts later picked up, and repeated, the hypo.
More seriously, it was very interesting to watch the “new bench” address its (current) eight-justice reality. The questions were very much all over the place. [1/2]
This was likely so, in part, because it’s not a high-profile, well-defined case — but also because a majority would take getting at least one justice from the “other side” of the general 4-4 ideological split. [2/2]
This morning, Chief Justice Roberts congratulated Justice Ginsburg on the 25th anniversary of her investiture at #SCOTUS, saying, “We look forward to sharing many more years with you in our common calling.”
