From 21 Jan 2019, EU Settlement Scheme opens to most EU cits & family members, allowing them to apply for indefinite leave to remain, or limited leave to remain (if not yet resident for 5 years). Short thread on who can apply. Don't @ me about politics of applying or not :) 1/
From 21 Jan 2019, EUSS opens for applications by:
- EU citizens holding a valid passport as an EU cit
- non-EU cits issued a UK residence card (permanent or not, and even if expired) under UK's EEA Regs, on an application made after 6 April 2005 2/

HO Press Release misstated position about family members, saying any UK biometric residence permit will do. gov.uk/government/new… 3/
Who can't apply :
- EU cits who don't have a current valid EU27 passport
- EEA/EFTA cits (unless they are also EU27 cits or family members of an EU cit)
- family members who weren't issued a biometric residence permit under EEA Regs 4/
As Chai points out:
- this UK law doesn’t affect current *EU law* rights of residence of EU cits & family members (down to 30 Mar 19)
- Home Office has promised to open scheme to *all* eligible by 30 Mar 19 5/
Immigration Rule EU5 explicitly confirm this: "the [EUSS] leave does not have effect to the person’s detriment in so far as the leave is incompatible with that [EU law] right to reside for as long as that person has that right" 6/

To keep right-wingers onside, May has played along with Britain’s nationalist fantasy. (Maybe she even believes it.)

But now fantasy is Remain’s best friend. Without it, Parliament would accept May’s deal.
Imagine May had responded to EUref saying “we will Brexit, but UK isn’t strong enough to dictate terms, so expect much worse trading conditions + binding guarantees of no hard border”

Would that early expectation management have led Parlt to come to terms with her deal by now?
Or is the nationalist fantasy to widespread & strong amongst MPs that her reality-acceptance would just have led to more effective nationalist opposition to her?

Good news & kudos to Times journalists.

But why had Ministers approved blanket charges, regardless of individual humanitarian cases?
Ministers can’t claim didn’t know about forced marriage when they made the policy.

10 years ago Ministers used forced marriage as excuse to ban people under 21 from living together in UK, where one partner wasn’t British. supremecourt.uk/cases/docs/uks…
Supreme Court didn’t accept that & quashed the Immigration Rule on 2011.

For UK Gov though, opposing forced marriage justified breaking up genuine marriages of British citizens and didn’t justify paying for British citizens who are actual victims to come home. 🤔

or 'when we leave the EU we will take back control of our money, our laws and our borders'. All of which is based on fallacy - claim of net out-flow of money has been demonstrated clearly many times, we elect our MEPs and the MPs who debate the EU regs and we have border controls
Astonishingly disdainful way she thinks of UK workers - they will be trained for the low skilled jobs currently done by people from EU27 countries, but we will still allow people in if they will have salary of £50k. She had no plan for immediate recruitment e.g. for care homes

1. Worst national leadership in my lifetime forcing through the most damaging, misguided & missold policy I can remember. Ideology & vested self interest replace statesmanship, soundbites replace sound judgement & autocracy subverts democracy.

2. A flawed Leave campaign based on lies, deceit, disingenuity & over simplification & a #Remain one fought w/o any positivity from the Govt & no real commitment from Labour, whose leader was virtually AWOL, did no justice to #Brexit complexity & betrayed our democratic process.
3. A mere 37% of voters/26.5% of the Ppl voted leave in a legally Non-Binding test of public opinion which has been corrupted, on the basis of an illegitimate political promise & interpreted as being the irrefutable Will of the Ppl.
The 1st is insufficient to claim the latter!

One obvious upside to the Royal Wedding: it will expose quite how farcically complex and expensive it is to keep someone you love in the UK. Meghan and Harry will breeze through this process no problem, but for many it is a huge financial and emotional burden. (1/15)
To start that process, Meghan will need to fill in a FLR(M) form. This is the standard form for a spousal visa. She can only make an application once she’s married to Harry. They’ll need to prove their relationship is genuine. The list of evidence required is extensive. (2/15)
The initial application will cost £993, plus a £200-per-year NHS fee. The application can take months and she will need to surrender her US passport during this time. She will be unable to leave the UK until the application has been processed. (3/15)

2/ This is a big deal for Barnier and especially MEPs and @GuyVerhofstadt who are adamant system should be as easy, stress free and cheap as possible to use.
3/ First up, a carrot ahead of December summit. UK wants to allow EU citizens to apply for residency as soon as Phase 1 signed off. Any application will not affect their existing rights.
