Update: In the matter of the Trump administration's would-be transgender military service ban, the plaintiffs in the last remaining injunction on Wednesday filed their response to the DOJ motion to stay the injunction. documentcloud.org/documents/5708…
"Plaintiffs do not oppose a stay of the nationwide effect of this Court’s preliminary injunction pending appeal," the lawyers write. They do, however, argue that the injunction should remain in effect as to the specific named plaintiffs.
When, at the least, the nationwide injunction in this case is stayed — as both sides agree is appropriate in light of the SCOTUS orders — the military will be free to start implementing the Mattis policy, which would ban nearly all trans people from joining the military.
So, a correction from my earlier tweets about the status of the trans military ban. It turns out that the injunction in the Doe case out of DC remains in effect. Although the DC Circuit panel ruled against the injunction, that decision has not yet gone into effect.
Now, today, the DC Circuit has filed an order that appears likely to extend the time before the mandate would issue in this case — a move that puts off when the district court would actually have to put the DC Circuit ruling into effect and vacate the injunction.
