Their complaint is that CNN had obtained a copy of the indictment by 6:22 a.m. The Justice Department posted a copy four minutes earlier.
Stone’s lawyers also complain that the indictment was still sealed when CNN (and the entire world) obtained it. But the order that sealed the indictment said that it would be unsealed upon Stone’s arrest, which was about 15 minutes before DOJ posted it. documentcloud.org/documents/5694…
The dumbest part of this whole conspiracy is the idea that CNN must have had advance notice of a Mueller indictment but decided to sit on the scoop.
Stone’s lawyers intimate in their motion the copy of the indictment CNN texted to them had been provided by the special counsel’s office. What they leave out is that the text described it as being a press release and linked to the DOJ website.
Stone’s lawyers also make a lot of the metadata in the indictment CNN sent them indicating it had been written by “AAW.” That’s identical to the copy DOJ posted when it announced Stone’s arrest.
This is a motion for publicity, not one designed to persuade a federal judge.
