If you try to separate yourself any further than that, it will come into force. But if you end up closer to Europe than that, then it will become redundant.
If the backstop became redundant it would only happen because its terms were replicated in whatever trade agreement followed.
You're all getting hung up on legal notices about this fucking backstop, like the most myopic little bureaucrats squinting their small print.
1. Northern Ireland is staying in the customs union.
2. If you want to maintain the integrity of the United Kingdom, all of it has to stay in the customs union.
