👇 I briefed EU27 Ambassadors and EP today on the ongoing talks with #UK. Following the EU-UK statement of 20 Feb, the EU has proposed to the UK a legally binding interpretation of the #Brexit Withdrawal Agreement. Most importantly:
2/5 The arbitration panel can already, under Article 178 WA, give UK the right to a proportionate suspension of its obligations under the backstop, as a last resort, if EU breaches its best endeavours/good faith obligations to negotiate alternative solutions.
3/5 EU ready to give legal force to all commitments from January letter of @eucopresident and @JunckerEU through joint interpretative statement. europa.eu/!Kj44wR This will render best endeavour/good faith obligations even more actionable by an arbitration panel.
4/5 EU commits to give UK the option to exit the Single Customs Territory unilaterally, while the other elements of the backstop must be maintained to avoid a hard border. UK will not be forced into customs union against its will.
5/5 The EU will continue working intensively over the coming days to ensure that the UK leaves the EU with an agreement.

EU watching Westminster closely this week but not rushing to any
conclusions. Here is some of the key thinking in European capitals on
the main #Brexit issues of the day: /1
On Labour/second referendum: Corbyn seen in Europe as convinced
eurosceptic so EU is sceptical of his backing a second referendum. EU
has watched #Brexit turmoil long enough to see huge complications in
holding the vote and realise many leave voters have changed their
mind. /2
Of course EU would still rather UK stayed but Europe's leaders don't
see this as realistically on the cards right now. Most realistic,
considering turmoil in Westminster, says EU council President Tusk:
would be to extend article 50 leaving process. /3

Ahead of @theresa_may’s latest visit to Brussels, where are we with #Brexit?!

A not-so-short thread which I hope simplifies a seemingly never-ending process but one which could have an abrupt end in less than 40 days. /1
Some context first: The key problem is the backstop - the Irish Protocol to us its proper name

It’s a section of the Withdrawal Agreement (WA) - a 585-page legal text which, together with a shorter Political Declaration (PD), forms the divorce treaty between UK & the EU. /2
The two texts - the WA & the PD - were the consequence of nearly two years of negotiations.

They were finalised + agreed by both the UK government (@10DowningStreet) and the EU (@EU_Commission) late last year. /3

"#Brexit and EU agencies", our extensive look into third country relationships of the 36 EU agencies and how the UK might fit in.

Albeit largely technical, agencies will have huge implications on Brexit.

Five points stand out in particular:
First, Agencies matter. Like the customs union, they are a technical aspect of the EU, that works and was thus hardly discussed in the UK before #Brexit.
But they are important for single market, but also justice and home affairs.

UK gov thus has already asked to continue participation in selected agencies, in particular in sectors important to the UK economy, like aviation, chemicals or pharma.

Ford Transit moved 2Turkey 2013 with EU grant.
Jaguar Land Rover recently agreed 2 build a new plant in Slovakia with EU grant, owned by Tata, same company who trashed our steel industry & emptied workers pension funds.

Peugeot closed its Ryton (was Rootes Group) plant and moved production to Slovakia with EU grant.
British Army's new Ajax fighting vehicles to be built in SPAIN using SWEDISH steel at the request of the EU to support jobs in Spain with EU grant, rather than Wales.

Dyson gone 2 Malaysia, with EU loan. Crown Closures, Bournemouth (Was METAL BOX), gone 2Poland with EU grant,employed 1,200.
M&S manufacturing gone 2far east with EU loan.
Hornby models gone. In fact all toys & models gone from UK along with patents all with EU grants

First major discussion point is of course that UK wants #Brexit transition to last until new relationship is in place.

3 things to learn from that:
a) A sense of realism is taking hold in Westminster on #Brexit. As long argued, a time limited transition is dangerous esp. for the UK, as it creates a new cliff edge. There is very little chance of a fully fledged future relationship negotiated, agreed and fully ratified by 2021
b) The EU strategy of making the UK ask for an extension has worked. If the EU had proposed this, it would have seemed like it wants to keep the UK close indefinitely.

Now it is clear that it is the UK, for economic reasons, that needs this potentially very long transition

#Brexit as a concept is increasingly drifting from having anything whatsoever to do with the mechanics of leaving the EU. It is now primarily a culture war and both sides will totally ignore the details except for when they are temporarily convenient.
The consequence of this is that our future relationship with the EU will be just as readily ignored as our activities as a member. They said Brexit would make us isolated, self absorbed and insular but it seems that was always the case and there are no signs of that changing.
As ever the details will be delegated to officials and civil servants while our establishment politics drifts further into its cycle of decline, unable to usefully influence external events making us entirely passive and reactive to events rather than self-interestedly engaged.
