In the modern era, Marshall, Burger, Rehnquist and Sotomayor would've barely been confirmed if a two-thirds vote was required, while Thomas, Alito, Kagan, Gorsuch and Kavanaugh all would've been shot down.
And you'd think those justices who *did * get just over the two-thirds mark might have also been shot down if the votes that put them over 67 had been the decisive ones, instead of just running up the score.
Put another way, by Howard Schultz's standard, we'd probably have three of the current nine justices -- Roberts, Breyer and Ginsberg. That's it.
