1/ @SethBTillman and I are grateful that the arguments we developed throughout the Emoluments Clause litigation were raised in the 4th Circuit today.
2/ Early on, we suggested that the official-capacity suit was not proper. The Plaintiffs only complained of quintessentially private conduct by the President. The court referenced our brief at 59:25 soundcloud.com/josh-blackman-…
3/ DOJ also embraced our argument concerning equitable causes of action and Grupo Mexicano--a case that no one in the litigation cited until our amicus brief.
4/ We look forward to the resolution of these issues in the 4th Circuit, as well as the 2nd Circuit (still pending), and in the District Court for the District of Columbia (still pending).
