@tribelaw Have you encountered, or thought about, the emolument clause's applicability to the following fact pattern: During a Presidential transition period, foreign govt. 'X' gifts U.S. individual 'Y' with several million dollars of valuable property. +
'Y' is widely expected to be a senior official in the incoming administration, and does, in fact, assume such a position post-inauguration. 'X' makes the gift in an early attempt to curry favor with the new administration.
Because 'Y' was not a federal official when the gift was offered and accepted, were any rules broken ? Is the gift reportable in any fashion ? I've asked @waltshaub the same question, without response thus far. Thanks for any insights.
