You mean, Texas Tech agrees to stop *regulating how race is used* in admissions.

Race is always used in college admissions whether or not there is a policy codifying how it can be considered. The effect of having no policy, as the Trump admin wants, will be worse racial bias.
This is what white conservatives don't get about affirmative action.

Even if there's a policy to not consider race, at some point the admissions officer is going to see your black-sounding name. Or note your majority back hometown. Or the interviewer will see you face to face.
Affirmative action isn't about creating a racial preference where none existed. It's about regulating the ways that race can and can't be used.

If you think you're not using race in these kinds of decisions, congratulations, you're the one with the racial preference.
We can argue about the ways that it is permissible to use race in college admissions — we've been having that argument for 60 years — but we need to stop pretending this is about using race vs not using race.

That toxic fiction is making real debate of this issue impossible.
