Barr hasn’t said if he’ll take the Nunes meeting —DOJ declines repeated requests for comment — but Barr indicated Monday that he’s anticipating what Nunes sends him. He said if they include appropriate criminal predicates, they’ll be investigated.
Among other concerns, “criminal referrals” from Congress are typically nothing more than glorified press releases. Unless Congress can supply DOJ with new evidence (like closed-door testimony or documents only in Congress’ possession) they carry little weight.
When a referral comes from individual members of Congress — like Meadows/Jordan referring Michael Cohen — they don’t often count for much in prosecutors’ eyes, committee sources tell me.
