The Senate whip count you’re hoping for will only come after you open the hearings and put the witnesses on the floor. Learn from Watergate. They didn’t have the votes either, until after they held the hearings.
Subpoena the unwilling, and while that’s litigating, put an endless array of willing witnesses on to testify to Trump’s vortex of criminality, vice, disloyalty, and wrong. The “unless” is all in the Mueller Report.

K, back to Barr’s meritless defense of Trump. If I rep someone, and I want to convince DA/AUSA not to charge, or drop charge, I persuade her that virtually no set of 12 jurors would believe their charge over my client’s defense. To do that, I would NEVER argue “mistake of law.”
“I didn’t know it was illegal” is the classic mistake of law, which is never a defense to a criminal charge. So if I ponied up Barr’s kind of defense - yep, my client stole $2500 leggings, but thought it was legal - I’d be laughed out of the DA’s office.
For obstruction of justice, various sections of 18 USC Ch. 73 can apply, depending on whether it’s investigation, enforcement or governmental proceeding you’re obstructing. But they all require an intent to obstruct justice - prevent authorities from doing that job.

So the non-law-student answer might be “no one committed a crime, because neither Jalisa or Becky meant to do what they did, and nobody actually stole anything.” That’s also the answer under Barr’s analysis of Trump. But it’s wrong, wrong, WRONG.
Set aside “specific intent” (written into the statute). Let’s just analyze the common-law distinction between “Murder” (homicide with intent to kill), “Manslaughter” (homicide with criminal intent, but not to kill),
“Accident” (no crime at all, maybe civil damages).
Jalisa feared for her life, shot a bum, didn’t kill him. Jalisa didn’t commit homicide, but MAY be chargeable with “assault with intent to commit grievous bodily harm.” She intended to kill, but depending whether she reasonably feared for her life, might have defense.

Other than his obvious corruption, Barr’s biggest problem in his defense of Trump is that it confuses “mistake of law” with “mistake of fact.” Barr’s refusal to charge relies on “Trump didn’t know he was breaking the law.” So let’s have a class in “mens rea” this morning.
“Mens rea” (modern folks don’t use the Latin) is just general “criminal intent” - divides civil from criminal conduct. You can owe someone civil damages for an accident. You’re not a criminal for an accident. Being careless doesn’t make you a criminal. (But wait, what?)
So from what I said, it sounds like lots of criminals, including Trump, would have defenses. Problem is, the law recognizes several levels of criminal intent between “I planned for weeks to shoot my roofer buddy’s head with this power nailer” and mere “whoops.”

1. I am so sick of hearing that the ONLY reason Trump should be impeached is if he conspired with a foreign power to steal the election. Let's remove that entire smokescreen and look at impeachment as a tool and why Trump needs to be impeached EVEN WITHOUT conspiracy allegations.

So why wait for #Mueller?
I see no reason House Dems can't begin the #impeachment process whether or not the Senate ultimately convicts. The rule of law should be upheld no matter what we think the ultimate outcome is. Waiting for #Mueller has allowed Trump/GOP to keep wreaking havoc on the country.
Can someone please explain the argument: "House Dems shouldn't impeach Trump because the Senate won't convict."

Isn't that effectively saying never impeach Trump?

If Dems don't stand for the rule of law against this treacherous gang of GOP leaders, what message does that send?
