Everywhere you look there is a 18 USC 1505 obstruction of Congress violation. Barr did it too.
The Courts will order all the attorneys to testify on the crime fraud exception. 100%. We are 30 days from Trump fleeing to Argentina. 😎
.@harrylitman on @MSNBC is right. @HouseJudiciary Dems need to tee up the crime-fraud issue in the DC ASAP. Judge Sullivan thinks it's treason. Maybe try to put it in front of him. Let the courts take more power. Judges love that.

1. In 1965 SCOTUS held that the right of marital privacy was violated by states banning birth control. Eight years later the court ruled 7-2 in Roe v Wade that the privacy right encompassed abortion and the court used history and common law to fashion the three trimester rule.
2. Simply, in the first trimester the court held that the state interest in the fetus was low and should give way to the woman's privacy. Second trimester added a higher state interest and by the third trimester the state could ban it.
3. If the Court says that a state legislature has the right to ban abortions it follows that a state legislature has the power to legalize it. That is how it was before Roe. But if the state can legalize it, the Congress can too. We are giving way to much weight to the Court

2/ Mueller was very cautious here. I could imagine a prosecutor pushing to find out the conversations behind this highly questionable voice mail to Flynn's attorney, by suggesting the attorney himself had significant liability and raising the specter of the crime-fraud exception.
3/ Most attorneys would recuse themselves in the face of that aggressive approach, and the specter of an inquiry of the circumstances around the voicemail might cause many defense counsel to back down and permit some disclosure to the prosecutor. But Mueller showed restraint.

Let's be clear here, this is what is going on with Barr.
1. As a matter of law, Barr cannot provide Congress with the grand jury information that Democrats just held him in contempt for not turning over to them.
2. Barr can, however, petition the courts to allow release, and the House Democrats have requested he do so. He refused, and this adds to their reasons for the contempt vote. Important to note, he is not required by law to accommodate their request to petition the court.
3. Democrats additionally feel his no-show for their hearing last week adds to their contempt charge. However, they had demanded, against normal order, that he be questioned by two prosecutors. Je did not agree but offered to teach an amicable arrangement.

Some quick Michael Cohen take-aways:
1. The committee repeatedly got Cohen to name Trump Org CFO Allen Weisselberg as a co-conspirator in a long list of crimes: Campaign finance felonies, tax fraud, insurance fraud, more fraud. Big deal: They will subpoena him. /1/
Weisselberg knows a lot about Trump's criminal role - perhaps in money laundering. Is Weisselberg cooperating with Mueller? His immunity deal may be limited. @AOC and @RoKhanna did great work focusing on Weisselberg, who will be subpoenaed and may take the 5th. /2/
2. Campaign finance: The checks w/Trump's signature are unmistakable. No doubt there is probable cause sufficient for indicting a sitting president. It's SDNY's domain, not Mueller's. Let's be clear: A sitting president can be indicted. It's time. /3/ slate.com/news-and-polit…
