Imagine you serve on a corporate board and you hire an investigator to look into claims that your CEO has committed crimes. The investigator says “if we could say the CEO was innocent we would. But we can’t say that.” What should that corporate board then do?
If you were an investor, would you invest in a company that responded to such an investigator’s report with a shrugging “meh?”
If you worked for that CEO, would you feel confident that you were not complicit with any actions that might make you criminally liable?
