SCL didn’t bother renewing its UK govt export controls. Too much paperwork said Nigel Oakes* per Brittany Kaiser. Didn’t renew PrivacyShield either demolishing Cambridge Analytica’s prior claims it honored all applicable data protection laws & treaties.
*Now owns SCL Insights Ltd
SCL/CA let its PrivacyShield registration expire about two weeks before the GDPR came into effect in May 2018. (Nix boasted to @CommonsCMS about how his company helps clients with GDPR compliance when asked about Americans seeking their voter data.)

— Facebook misled reporters when harvesting was discovered. Reporter (@carolecadwalla) had to find whistleblower to find truth being withheld. SEC penalty notes the deceptions. sec.gov/news/press-rel…
— Nix misled DCMS Parliament committee about Facebook data. Had to be recalled to clarify, a trainwreck of more lies. Brittany Kaiser’s hard drive evidences use of Facebook data after falsely certified deletion and concerns over data protection law violations for LeaveEU work.

The next great hack is around #MoscowMitch who will surely block a landmark national privacy law. We must pass privacy laws in the statehouses first so that the industry pressures McConnell for preemption but voters will gain federalist leverage over the inevitable concessions.

Irish data protection authority: U.S. law doesn't provide remedy for unlawful processing of personal data. There is no way of knowing when or by whom personal data has been accessed.
Irish data protection authority: U.S. legal regime doesn’t legal remedies such as access, erasure or rectification of the data. The Ombudsperson mechanism is not enough to make up for these "deficiencies."
Reminder: The Ombudsperson mechanism is also used for the #PrivacyShield.

UCC had opportunity to comment on the #Data.Protection & Privacy Bill. The enactment of this law is long overdue. A comprehensive law on the collection & processing personal information gives effect to the right to Privacy envisaged under Article 27(2) of the Constitution
UCC welcome the protections offered by the Bill in terms of export of data, breach notification requirements, data subjects access rights, automated decision making, compensation and the right to be forgotten and provision for financial and penal sanctions for breach of the law.
Distinction between Data collectors & data controllers.
The Bill should however clarify & distinguish Data Collectors, from Data Processors & Data Controllers. Clause 2 is inconsistent with international good practice which provides for two broad categories of Data Controllers

Cambridge Analytica who worked with Trump’s team and the winning Brexit campaign harvested millions of FB profiles of US voters, in the tech giant’s biggest ever data breach, and used them to build a powerful software program to predict and influence choices at the ballot box.
They used personal information taken without authorization in early 2014 to build a system that could profile individual US voters, in order to target them with personalised political advertisements.
