More than 100 former members of Congress filed a brief supporting our lawsuit against the President's emergency declaration to build the border wall.

They write, "The Constitution gives Congress, and Congress alone, the power to fund our federal government ... Frustrated with the Constitution's allocation of power between the legislature and executive, the president has hijacked the appropriations power."
Instead of vetoing Congress's spending bill, which did not provide his requested level of funding, President Trump signed it, leaving him "with no lawful way to spend federal money on a wall."

His emergency declaration is an assault on the Constitution's separation of powers.
