UPDATE: Politico's official impeachment inquiry whip count has moved to 135 Democrats. Today's adds:

-Takano
-Schneider
-Keating
-S. P. Maloney (said he'd vote for it if it comes up)

NOTE: Our count is slightly higher than some others because we believe it's correct to include Democrats who said they would vote "yes" on an impeachment inquiry if it comes up -- but aren't necessarily in favor of that course.

That includes S.P. Maloney, Bass and Pallone.
At the end of the day, a commitment to vote for an impeachment inquiry or impeachment itself is as much an indicator of support -- maybe even more so -- than stating an opinion in a press release or tweet.

Lewandowski’s testimony to Mueller was key to one of the most vivid episodes of potential obstruction. Trump asked him to tell Jeff Sessions to block the Russia investigation or be fired.
Lewandowski passed the order on to Rick Dearborn (who isn’t showing today under orders from the WH). And Dearborn never followed through.

Mueller notes that Trump’s aides/allies aren’t accessories to potential obstruction because they didn’t carry out the orders.

NEW: Nadler says the Judiciary Committee is too bogged down "impeaching Trump" to turn to a Kavanaugh probe right now.

Says the next step on Kavanaugh will be when Wray comes in for a previously scheduled hearing next month.

NADLER also made his strongest comments to date on impeaching Trump, saying it's "imperative."

HMMM: SCHIFF has issued a cryptic subpoena, claiming an intel community whistleblower's complaint has been withheld from Congress -- and could, perhaps, involve the president.
NEW: Schiff is hinting at a potentially massive whistleblower complaint against Trump or other senior WH officials coming from an intelligence official.

But in a statement, accompanied by a subpoena, Schiff says it's been illegally withheld form Congress. politico.com/story/2019/09/…
Rather than turn over the complaint as statute requires, Schiff claims DNI Maguire shared it with DOJ lawyers and claimed it might be privileged.

CLEARING UP THE #IMPEACHMENT CONFUSION

This is the third article today about the muddled message from Dem leaders.

It's actually very simple:

#Pelosi has no intention of impeaching Trump.

#Nadler was fine with that. Until @LindseyBoylan, a serious challenger, came along...
@LindseyBoylan So @RepJerryNadler has managed to hide behind @SpeakerPelosi and blame her for slow-walking #impeachment.

But for months, he was downplaying #impeachment ... before he got a serious challenger.
@LindseyBoylan @RepJerryNadler @SpeakerPelosi In the end, #Nadler is trying to keep his seat, so he's playing politics with his most sacred duty as a representative, to protect the Constitution.

And he's doing it by pushing what I call "Schrödinger's impeachment" -- an impeachment inquiry that isn't really one.

It's time I had my say about #Impeachment, DJT's obstructionistic tactics, and @SpeakerPelosi's not pushing for an inquiry yet.

When AG Barr released the redacted version of the report to Congress, he did *not* include any of the underlying documents on which Mueller relied.

Just like a lawsuit, a case has to be built based on facts and evidence. Both the Intelligence Committee and the Judiciary Committee have been working their way through the system, including voting to hold AG Barr in Contempt of Congress. DJT has been fighting them in court.

2/
Meanwhile, the Ways and Means Committee has also been working on getting DJT's tax returns. One of the Committees has also been working on getting records subpoenaed from DJT's financial management firm and from Deutche Bank, known for Russian money laundering.

A note on #impeachment -

In a court of law, under non-presidential circumstances, impeachment is a tool litigation attorneys use to discredit the opposing side's witnesses at trial. When said witness takes the stand under oath attys. present evidence contrary to what the witness
claims. This weakens the other side's case by discrediting impeached witnesses's testimony. Once a witness has been impeached - by presentment of inconsistent testimony - the judge/jury can no longer use the impeached witnesses's testimony in reaching a verdict.
Simply put, they aren't trustworthy. In the case of Presidential impeachment that broad definition of impeachment applies, but the impeachment tool is used for a very different purpose. Under the Constitution, a sitting President cannot be tried in a court of law for anything.

Impeachment Catch-22.
Before starting an official impeachment inquiry, @SpeakerPelosi is waiting for a big shoe to drop from tax returns, bank records, big televised testimony...
But judges might deny subpoenas for pretexts, if Dems don’t honestly cite impeachment inquiry...
How to resolve it?
A cost-benefit analysis, weighing priorities.
1. What‘s the chance a committee impeachment inquiry - not an impeachment vote - will hurt Dems politically? Split her caucus? Jeopardize swing seats?
She knows better than I do, and it’s her job to prioritize them.
2. What‘s the chance judges create new subpoena precedent that pretextual purposes are not legitimate or reasonable?
I think she underrates those chances. Just like underrating the risk of not calling the ACA individual mandate a “tax,” which almost doomed the entire ACA in 2012.
