NYT Justice reporter says former FBI Acting Director McCabe has been advised he’ll be indicted. DOJ just lost a trial involving similar charges against former WH Counsel Greg Craig.
Of course, prosecutors still need a grand jury vote in favor of indictment. That is usually a foregone conclusion, as prosecutors need only present probable cause to obtain one (although it's unwise to do so without the proof beyond a reasonable doubt necessary to convict).
Wow! @adamgoldmanNYT suggests there isn't an indictment yet, despite DOJ's rejection of McCabe's appeal to the DAG, because the grand jury declined to do so. That doesn't happen often & when it does, it's a signal prosecutors shouldn't ignore.
