A (perhaps trite) thought about the common law. Yesterday, legal commentators were busy speculating about how the Supreme Court would rule. Today, the Supreme Court delivered a judgment which surprised them all. 1/4
The core disagreements (on prorogation, and on the proper relationship between Parliament and the Crown) will continue. But, future legal arguments have to take account of the judgment of the Supreme Court. 2/4
Some legitimate views are now seen to be misconceptions. Some areas of clarity have been sketched. But, new uncertainties have also been created. All aspects of the judgment will be probed. 3/4
We are seeing the law develop, and the Constitution evolve. Its a fascinating process to observe. 4/4
