#Breaking: A federal Judge overturned the conviction of Flynn’s business partner Bijan Rafiekian. Judge said the governments evidence was insufficient, but that the government could appeal the decision.

Lots of drama in Flynn-land these days. In short: after firing his Covington counsel and securing new attorneys, Flynn changed his planned testimony for the upcoming trial of his business partner Bijan Rafiekian. So the gov't decided it couldn't call Flynn as a witness at all.
The government had almost certainly had intended to call Flynn to testify about facts he had agreed to back in 2017, in his Statement of the Offense. That included the fact that he lied in his FARA filing about his knowledge of Turkey's involvement in the Inovo contract.
Then in June 2019, just before Rafiekian's trial is to begin, Flynn's new counsel made a surprise announcement to the DOJ: hey, remember that time Flynn stipulated in court to committing a crime? He was just super confused, he didn't really meant to stipulate to that at all!

In other Mueller news on this busy news day, a judge in Alexandria, VA today indefinitely delayed the scheduled February trial of Flynn business partner Bijan Rafiekian. Feds had asked for a two-week delay. (1/x)
Recall that Flynn's sentencing was unexpectedly postponed last month so the judge could see how helpful Flynn was in the case. Mueller and Flynn lawyers were supposed to get back to him by March 13 on how that was going. (2/x)
Idea that Rafeikian trial would start in February, was always, frankly, insane. There are classified information issues in the case. Once CIPA process begins better question would be: which February? Anyway, another indication how timelines often slide to the right (3/x)

It’s the first ruling in federal court to define “emolument,” which goes undefined in the Constitution’s two emoluments clauses.
Federal District Judge Peter Messitte rejected the “cramped interpretation” of the term offered by Justice Department lawyers, who argued the case should be dismissed.
