CLERGY MUST RECOGNIZE that when the Apostolic See is impeded by a sede vacante or pope paralyzed by madness or substantial fear, they have ever right to refuse heretics as their Bishop and publicly move to have the Clergy excommunicate them and elect another to be their Bishop.
This is morally licit and canonical, on account of what is said in the last canon of the 1983 code: the Highest Law is the salvation of souls!
As for the power to excommunicate their own bishop for heresy. When the Bishops of the province refuse to do that, they can act in virtue of the principle of subsidiarity, affirmed by Pope Leo XIII, and because pastors already have this power in their parishes.
In summation: All Catholics have the duty to take canonical action to preserve the Sacred Hierarchy and Sacraments and the Dioceses in which they live. Simply "resisting" by complaining, blogging, lamenting and hiding IS NOT CATHOLIC! The Church belongs to those who believe!
For this reason it is a real NECESSITY AND DUTY for the laity who have the faith to urge the Clergy who still have the faith to act and support them. It would be good that Catholics put ads in newspapers and begin forming committees of resistance to the Amazon Synod's proposals
The chief legal problems arise from this that in modern laws of most nations the Bishop can steal all the property of the Diocese from the priests and faithful. So a heretical bishop is a real and imminent threat to all the faithful. And a difficult legal problem in civil law.
THIS IS WHY PPBXVI.ORG is not only important for the Vatican or Church of Rome, it is the very legal basis of the claim of all Catholics to take their church properties back from heretics appointed by Bergoglio or in communion with him, because he has no right!
This is the tremendous power and grace which is hidden in Pope Benedict's renunciation of ministry, when seen correctly according to the norm of Canon Law and in the context of current events.
In this way Benedict merits the title Gloria Olivae (the Glory of the Olive), because just as an olive tree which seems to be destroyed by fire re-sprouts from its ancient trunk, so from his Pontificate, seemingly destroyed, there can re-sprout the entire Church world wide.
